Welcome to AIC-AI.com (“Site”), operated by the RES Group, LLC (“AIC-AI,” “we,” “us,” “our”). These Terms of Service (“Terms”) govern your access to and use of our website and any related services, content, and applications (collectively, the “Services”) that link to these Terms.

AIC-AI specializes in AI-Automation & Integration and B2B customer acquisition. Our Site provides:

Information about our company and the services we offer.
A blog, whitepapers, and other educational content related to AI and B2B marketing.
Contact forms and other mechanisms for you to express interest in our services.

Any formal client engagement for AI-Automation, Integration, or B2B customer acquisition services will be governed by a separate, mutually executed Master Service Agreement (MSA) or Statement of Work (SOW).

3. Intellectual Property Rights
a) Our Content: All content on this Site, including but not limited to text, graphics, logos, images, software, and the compilation of all content, is the property of AIC-AI or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, distribute, or create derivative works of our content without our express written permission.

b) Client Data and Outputs: For paying clients under a separate agreement, the intellectual property rights to client-provided data (“Client Input”) and the specific deliverables created for the client (“Service Outputs”) will be defined in the respective MSA or SOW. In the absence of a specific agreement, you agree not to assert any claim that Service Outputs constitute infringing or derivative works of your Client Input.

c) AI Models: Our services may utilize third-party artificial intelligence models and platforms. You acknowledge that the outputs generated by these AI systems are provided for your use but may not be unique and that other users may receive similar outputs. AIC-AI does not claim ownership of your Client Input, but you grant us a license to use it to provide the Services.

4. User Accounts and Responsibilities

DUE TO THE INHERENT NATURE OF AI AND MACHINE LEARNING, OUTPUTS FROM OUR DEMONSTRATION TOOLS OR SERVICES MAY NOT BE ACCURATE, COMPLETE, OR RELIABLE. YOU SHOULD NOT RELY ON THESE OUTPUTS AS A SUBSTITUTE FOR PROFESSIONAL ADVICE. AIC-AI DOES NOT GUARANTEE THE ACCURACY, USEFULNESS, OR SAFETY OF AI-GENERATED CONTENT.

7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AIC-AI, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SITE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE; OR (III) ANY AI-GENERATED OUTPUTS OR CONTENT.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE SHALL NOT EXCEED $100 USD OR THE AMOUNT YOU HAVE PAID US IN THE PAST SIX MONTHS, WHICHEVER IS GREATER.

8. Indemnification
You agree to defend, indemnify, and hold harmless AIC-AI and its licensors from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from: (a) your use of and access to the Site; (b) your violation of any term of these Terms; or (c) your violation of any third-party right.

9. Governing Law and Dispute Resolution
These Terms shall be governed and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
Any dispute arising from these Terms or your use of the Site shall be resolved through final and binding arbitration in Fort Myers, Florida, rather than in court. Note: You may choose litigation instead.
